A man who defrauded dozens of Moncton-area residents through a snow-removal scam last year has been denied a hearing to appeal his convictions.
Edward Faulkner, 58, who was known by several aliases - including Edward Mcailster - was sentenced to six and a half years in prison last spring over the scam. He was convicted of 39 counts of fraud.
He sought an appeal on grounds that raised questions of fact or questions of mixed law and fact.
"In our view, the grounds Mr. Faulkner wishes to raise in his appeal essentially ask us to retry his case. However, as has been said many times before, such is not the role of a Court of Appeal. His application for leave to appeal is therefore dismissed," a three-judge panel wrote.
Several residents testified in court earlier this year that they paid Faulkner $226 in cash for driveway clearing services last autumn. But when the first snowstorm arrived in November, no one showed up to clear their driveways.
